In 1980, the Virgin Islands Public Employees Relations Board ("PERB") was established by Act 4440, Title 24 V.I.C., Chapter 14, Sections 361- 383, which provides for constructive labor relations between the Virgin Islands Government and its employees. The PERB is an impartial agency; it CANNOT and DOES NOT give advice to parties. The PERB is a board composed of five (5) members appointed by the governor with the advice and consent of the Legislature. Two (2) of the members shall have experience involving labor relations on behalf of labor and two (2) members shall have experience involving labor relations on behalf of management. The fifth serves as Chairman of the PERB. The Act also requires that at least two (2) members represent the District of St. Croix and at least two (2) members represent the District of St. Thomas and St. John.
ESGR (Employer Support of The Guard and Reserve) awards program culminates with the Secretary of Defense Employer Support Freedom Award. It is the U.S. Government's highest recognition given to employers providing outstanding support to their employees serving in the National Guard and Reserve. The PERB serves as administrative law judges and hears cases to determine whether rights guaranteed by the Act have been violated.
The PERB determines which positions can be in a union and which are excluded.
The PERB conducts elections for employees to decide if they want to be in a union or which union they want to represent them.
The PERB mediates impasses in collective bargaining agreement negotiations and arranges for mediation, and if necessary, arbitration.
The PERB trains mediators and arbitrators and provides the parties panels of mediators and arbitrators.
The PERB conducts public education about labor relations and tries to foster harmonious labor relations.
